India Supreme Court rejects calls for probe

20 April 2018

The BJP rejoiced on Thursday at the Supreme Court's rejection of a demand for a probe into judge B.H. Loya's death and sought an apology from Rahul Gandhi for leading a delegation to the President to demand one.

Deploring the role played by Bhushan in the case, justice DY Chandrachud, who authored the judgment on behalf of the three-judge bench, said, "Prashant Bhushan adopted a dual mantle and went to the length of personally collecting evidence to bolster the case".

However, later in the day, the Supreme Court registry termed the incident as a "technical snag" and said that the technical team was working to rectify the official website.

Xi Jinping Congratulates Cuban President Miguel Diaz-Canel

During their 12 January press conference, four senior-most apex court judges - J Chelameswar, Ranjan Gogoi, MB Lokur and Kurian Joseph - had questioned the manner in which sensitive cases were being allocated and Loya's case was one of them.

This is not about the Supreme Court getting cold feet about investigating a political bigshot. "There is no reason for the court to doubt the clear and consistent statements of the four judicial officers", the court said. The bench observed that the petitioners tried to scandalise the judiciary.

Addressing the media soon after the apex court pronounced its verdict over death of Judge Loya, who was earlier holding trial in the Sohrabuddin Sheikh staged shootout case, BJP spokesperson Sambit Patra said the petitions were filed with a political agenda.

"Bharat Tere Tukde Honge" gang might choose to ignore the Supreme Court but the Nation knows truth has prevailed.? A clutch of pleas, including those by Congress leader Tehseen Poonawala and Maharashtra-based BS Lone, was filed in the top court, seeking an independent probe into the death. Loya died of cardiac arrest in Nagpur on December 1, 2014, when he had gone to attend the wedding of a colleague's daughter. "I urge Rahul Gandhi (Congress president) not to fight political battles through corridors of court", as per ANI. "The Congress, its president Shri Rahul Gandhi and Smt Sonia Gandhi should apologise for this sin", Naqvi told reporters.

February 19: SC says it was treating Loya's case with utmost seriousness and for a cause. "There has been no investigation till date in death of Judge Loya".

The state government had defended its probe, which established that Loya's death was natural, and categorically stated that a fresh probe will "unnecessarily bring the judiciary into disrepute".
