NY Officials Denounce Trump 2020 Census Immigration Question

07 April 2018

Led by NY, a group of 17 states, six cities, and the District of Columbia along with the U.S. Conference of Mayors filed a federal lawsuit against the Census Bureau and Commerce Department to remove a new citizenship question which has not appeared on the Census since 1950 from appearing on the upcoming 2020 Census.

Schneiderman says an undercount threatens billions in federal funding for NY and fair representation in Congress and the Electoral College. "This maneuver will not withstand constitutional scrutiny", he said. The resultant population undercount would jeopardize the Census Bureau's ability to determine how many people are in each state, threatening states' fair representation in Congress and the Electoral College. Our state and City are united in fighting against this attempt by the Trump administration to stifle democracy, strip our community of much-needed resources, and undercount communities of color and immigrants, " said Mayor Durkan. Mayor Durkan will continue to work with the City Council, community groups, and regional government partners to plan for a grassroots effort to ensure every person is counted in the 2020 Census.

Patriots looking to trade up to draft Baker Mayfield?

The Trump administration absolutely can not be allowed to contradict the standards set up by the U.S. Constitution, nor the rules that have been applied in Censuses for the better part of the last 70 years. It is also brought under the Administrative Procedure Act, which permits courts to set aside unlawful or arbitrary and capricious agency decisions.

"One of the federal government's most solemn obligations is a fair and accurate count of all people in the country, citizen and non-citizen alike", Schneiderman said Tuesday. The wiser heads at the Census Bureau at the time understood that even if the respondent was born in the U.S.to citizen parents, many still had a fear of Immigration and Customs Enforcement and would not participate.

Engel is also a cosponsor of federal legislation, the 2020 Census IDEA (Improving Data and Enhanced Accuracy) Act, that would ensure the 2020 census is free from politicization and accurately reflects the American population. "Yet this question about citizenship discourages accuracy and inclusion and it runs counter to the intent behind the law, as inscribed in our Constitution". Former U.S. Census Bureau directors of both parties have historically supported the exclusion of questions relating to citizenship and legal status on this basis.

Federal funding and congressional representation are at stake in the dispute over the Trump administration's move to reinstate the citizenship question to the 2020 census.
